Eastern Band approves resolution to study building Class II gaming facility in county

Legal gambling is a step closer to becoming reality in Cherokee County.

    On March 1, the Eastern Band of Cherokee Indians Tribal Council approved a resolution to look at potential land opportunities and study the financial feasibility of establishing a Class II gaming facility in Cherokee County, Principal Chief Michell Hicks said.

    “We are moving to the next phase,” he said. “We are still looking at the feasibility. The council decided to go a step further.”
    Hicks added that a final decision is “still a ways off.” A committee is looking at possible locations for a gaming facility.

5,367 acres available

    The Eastern Band owns 5,367 acres in Cherokee County, which is 1.8 percent of the county’s total of 298,484 acres. By comparison, the Tennessee Valley Authority owns 8,229 acres, or 2.76 percent of total county acreage, while the U.S. Forest Service owns 92,638 acres, or 31 percent of total county land.

    The Eastern Band owns property in Marble, Andrews, near Western Carolina Regional Airport, just northeast of Murphy, and a large portion between Hanging Dog Road and Joe Brown Highway.

    The Tribe owns 1,203 acres off U.S. 19 behind and near Snap-on Tools, the National Guard Armory and Walmart. Wells Road runs through the property.

    Diane Wells with Wells & West development corporation is a tribal member. She said a person must go over deeded property from U.S. 19 to get to the 1,203 acres of tribal land.

    “We are the closest we have ever been [to having a gaming facility in Cherokee County],” she said. “I have a big interest in seeing gaming come to this county. It would not only enlarge the economy, but it would provide jobs.

    “It would be wonderful for our tribal people to set up a gaming facility here. Wells & West has no proposal on the table to build anything for the tribe. At this time, the only connection [between Wells & West] and the tribe is that I am a member.”

    Tribal member Mike Parker said he doesn’t know of any specific targeted land for a gaming facility in Cherokee County.

    “This casino might be a needed shot in the arm for economic development and jobs,” County Commission Chairman Jonathan Dickey said. “This could help get us through these bleak economic times. We desperately need to bring jobs to people.”

3.5-4 million visitors

    Dickey said he has been told that a gaming facility could draw 3.5-4 million people to the county. Most of the visitors would come from the west. Anyone coming from the east probably would stop at the casino in Cherokee first.

    A gaming facility in Cherokee County on tribal land could sell alcohol if it desires, even in the unincorporated portion of the county, he said. No ad valorem taxes can be collected from tribal land, and no sales taxes can be collected from businesses on tribal land.

    If the tribe purchases deeded land, possibly for access to tribal land, that property would go off the county’s tax books and no ad valorem taxes could be collected. In addition, any business or industry on tribal land must be owned and operated by a Native American, Dickey said.

    The negative aspect of a gambling facility is that there will be abuses with gambling, Dickey said. Being addicted to gambling could wreck havoc in a person’s life.

    However, it would be a boost to the local economy. Businesses probably would spring up on non-tribal land near the gaming facility, such as franchise restaurants, he said. Developers may build shopping facilities as well as other ventures.

Games people play

    A Class II gaming facility includes high-stakes bingo and some electronic games. According to the Journal of Economics and Economic Education Research, Congress passed the Indian Gaming Regulatory Act in October 1988. It established three classifications of gaming:

    • Class I gaming is defined as traditional Indian gaming that is part and parcel of tribal ceremonies and 

celebrations;

    • Class II gaming covers several types of gambling including lotto, pull-tabs, bingo and some types of card games;

    • Class III gaming – which is what Harrah’s Cherokee Casino is – includes blackjack, slot machines and all other types of gaming that are not included in either Class I or Class II.

    Wells said the tribe has done about all it can do in developing the casino in Cherokee. The next logical move would be a facility in Cherokee County.

    In the early stages, a local facility would not have the numbers of people and money flowing through that the tribal casino has, she said. However, Class II machines are far more than just a bingo hall.

    If the Eastern Band wanted another Class III facility, the governor would have to approve amending the contract between the state and tribe, Wells said.

    “Our chief has visited many Class II facilities,” she said. “It would be a shot in the arm for us.”

    In July 2008, Harrah’s Cherokee Casino announced that it would move ahead with a $650 million expansion despite a downturn in the gaming industry. Gaming News reported that the casino is one of western North Carolina’s largest employers with 1,800 workers. The expansion, scheduled for completion in 2012, will double the gambling floor space and turn Harrah’s Cherokee into a resort-like destination, company officials said.

    The casino had a combined payroll of $79.9 million in 2004 and additional discretionary income in the form of distribution of gaming funds to members of the Cherokee tribe, officials said. More than 3.5 million people visit the casino and hotel annually.

October Home Sales Far Exceeded Expectations

Existing-home sales in October rose to the highest level in more than two years, according to a report released Monday, driven by the popularity of a credit for first-time home buyers. The surge far outpaced expectations and nurtured hope that the stubbornly frail housing market might be on the upswing.

Sales of existing homes were up 10.1 percent in October to an annual rate of 6.1 million, the National Association of Realtors said in a report Monday — a level last seen in February 2007, before the collapse of the housing sector. Analysts surveyed by Bloomberg News had predicted a 2.3 percent increase.

The group attributed the gain to the popularity of a government-financed credit of up to $8,000 for first-time home buyers, which was renewed earlier this month. In addition, consumers are taking advantage of lower prices and mortgage rates, even at a time of pervasive unemployment and uncertainty over the pace of economic renewal.

Inventories continued to shrink, the report said, and prices, while still lower, fell by the smallest amount in more than a year.

Sales were up 23.5 percent from the October 2008 rate of 4.94 million. In addition, sales for the 12-month period from October 2008 to October 2009 reached 4.4 million, up slightly from the October 2007 to October 2008 levels.

The gains surprised even the Realtor group’s chief economist, Lawrence Yun, who cautioned that future results may be more modest. “With such a sale spike, a measurable decline should be anticipated in December and early next year before another surge in spring and early summer,” he said.

Economists closely monitor trends in home sales because their effects ripple through the economy. Consumers, in effect, are not just buying houses: they are also furnishing them with items like washers, tables and mattresses. Once Americans begin to spend again, analysts expects businesses will begin hiring and the economy will be on firmer ground.

The report examined sales of single-family homes, as well as condos and co-ops. The group revised its September figures, saying home sales rose by 8.8 percent rather than the 9.4 percent it originally reported.

Even amid inklings of a turnaround for housing market, there are still reminders that the sector remains very weak.

Just last week, the government reported that builders broke ground on new homes at the slowest rate in six months. Construction of apartment buildings reached the lowest level since the department started collecting housing data in 1959, and building permits, an indicator of future construction, also fell.

Celia Chen, senior director at Moody’s Economy.com, noted that sales of existing homes — especially those that have been foreclosed and tend to be cheaper — may be slowing the pace of home construction, as builders grapple with low demand for expensive new homes.

“The housing sector needs help,” she said. “It’s important to shore up the market because that is a large part of the economy and will be helpful in stabilizing the broader economy.”

And while home sales may be picking up, consumers still face slender paychecks and are struggling to keep up with bills. The Mortgage Bankers Association said last week that nearly one in 10 homeowners with mortgages — about five million households — was at least one payment behind in the third quarter.
